This Telehealth Informed Consent describes the nature, benefits, and limitations of receiving healthcare services through telehealth with Aries Mens Health, a brand operated by Ariez Biocorp LLC. It is written to satisfy the informed-consent requirements for telehealth services provided to residents of the State of New York under New York Public Health Law Article 29-G and related regulations. Please read carefully. By continuing to use our services, and by acknowledging this consent during intake, you confirm that you understand and agree to the following.
1. What telehealth means
Telehealth, as defined under New York Public Health Law §2999-cc, is the delivery of healthcare services by means of synchronous and asynchronous information and communication technology (including video, audio, secure messaging, store-and-forward imaging, remote patient monitoring, and file transfer) where the patient and clinician are not in the same physical location. With Aries Mens Health, your licensed clinician may evaluate you, review your laboratory results, provide clinical recommendations, issue prescriptions where appropriate, and conduct follow-up visits entirely remotely. Your clinician holds an active license to practice medicine in the State of New York (NY License #253833-01) and provides services only to patients physically located in New York at the time of service.
2. Expected benefits
- Increased access to specialized men's health and hormone-optimization services.
- Convenience — no travel required for most visits.
- Coordinated review of laboratory data by our licensed clinical team.
- Faster follow-up and easier protocol adjustments.
3. Possible risks and limitations
- No in-person physical exam. Certain findings that are detectable only with a hands-on physical exam may not be identified through telehealth.
- Technology failures. Internet or device issues may delay or disrupt a visit.
- Privacy limits. While we use HIPAA-aware systems and reasonable security safeguards, electronic communication carries inherent risks of unauthorized disclosure. We minimize these risks through encryption, access controls, and workforce training.
- Limited scope. Telehealth is not appropriate for emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency department.
- Clinical discretion. Your clinician may determine that an in-person visit with another provider is needed. In that case, your clinician will advise you.
4. Alternatives to telehealth
You have the right to seek in-person care with another provider at any time. You are not required to continue using telehealth services with Aries Mens Health and may withdraw consent at any time.
5. No guarantee of outcomes
Clinical recommendations reflect professional judgment at a point in time based on the information available. Individual results vary. No particular outcome is guaranteed.
6. Prescriptions
Prescriptions, if any, are issued by a New York–licensed clinician based on your clinical evaluation and dispensed only by pharmacies licensed by the New York State Board of Pharmacy (or by the applicable state board for patients in other licensed states). Your clinician may decline to prescribe any therapy if, in their professional judgment, it is not clinically appropriate. Controlled substances (where applicable) are prescribed only when consistent with federal and state law, including the Ryan Haight Online Pharmacy Consumer Protection Act (21 U.S.C. §829(e)), the New York Public Health Law (including §3302 et seq. governing controlled substances), the New York Internet System for Tracking Over-Prescribing (I-STOP) Act, and any applicable telehealth controlled-substance regulations in effect at the time.
7. Privacy, security, and recording
Your telehealth visits are handled in accordance with applicable federal and state privacy and security laws, including the Health Insurance Portability and Accountability Act ("HIPAA"), the New York Stop Hacks and Improve Electronic Data Security Act ("SHIELD Act," N.Y. Gen. Bus. Law §899-bb), New York Public Health Law Article 27-F (confidentiality of HIV/AIDS-related information where applicable), and the terms of our Privacy Policy and Notice of Privacy Practices. Our telehealth sessions are conducted through technology vendors who are bound by Business Associate Agreements where required. Visits are not recorded without your knowledge. If recording is proposed for clinical or educational reasons, we will obtain your explicit written consent in advance, consistent with New York's one-party consent recording rule and HIPAA's authorization requirements.
8. Patient responsibilities
- Be in a private, quiet location for telehealth visits.
- Confirm your location at the start of each visit (your clinician must know what state you are in).
- Provide accurate and complete information.
- Follow protocols your clinician provides and report side effects or concerns promptly.
- Seek in-person emergency care when needed.
9. Your rights as a New York patient
- Right to refuse or withdraw consent. You have the right to withhold or withdraw this consent at any time without affecting your right to future care, consistent with N.Y. Public Health Law §2999-cc(4).
- Right to in-person care. You have the right to request an in-person referral and to receive the name of at least one other qualified provider who may offer in-person services when clinically indicated.
- Right to access your medical records. You may request copies of your medical records held by Aries Mens Health, and to request amendment or an accounting of disclosures, as described in our Notice of Privacy Practices and consistent with HIPAA and N.Y. Public Health Law §18.
- Right to ask questions. You may ask your clinician any question about your care and expect an answer you understand.
- Right to file a complaint. You may file a complaint about clinical care with the New York State Department of Health, Office of Professional Medical Conduct (OPMC), 433 River Street, Suite 303, Troy, NY 12180-2299. You may file a complaint about privacy practices with our Privacy Officer at support@ariesmenshealth.com, with the U.S. Department of Health and Human Services, Office for Civil Rights, or with the New York State Attorney General's Bureau of Internet and Technology.
- Right to a qualified interpreter. Interpretation services are available on request at no cost to you.
10. Emergency protocol
Telehealth is not suitable for medical emergencies. If you are experiencing chest pain, shortness of breath, a severe allergic reaction, thoughts of self-harm, suicidal ideation, or any other urgent medical condition, call 911 or go to the nearest emergency department. Your clinician will ask you to confirm your physical location at the start of each visit so that, if an emergency arises during the session, we can assist you in contacting local emergency services.
11. Regulatory oversight
Physicians providing services through Aries Mens Health are licensed and regulated by the New York State Department of Health, Office of Professional Medical Conduct (OPMC), 433 River Street, Suite 303, Troy, NY 12180-2299. Nurse practitioners are licensed and regulated by the New York State Education Department, Office of the Professions, 89 Washington Avenue, Albany, NY 12234. License status is publicly verifiable through op.nysed.gov and apps.health.ny.gov/doh2/applinks/physicianprofile.
12. Acknowledgment
By continuing to use Aries Mens Health telehealth services, and by checking the telehealth consent box in your patient portal at intake, you acknowledge that you have read and understood this consent, that the service was offered in your preferred language, that all your questions have been answered to your satisfaction, and that you voluntarily agree to receive care via telehealth. This consent satisfies the informed-consent documentation required under New York Public Health Law Article 29-G.
